The Bar Council of the Maldives (BCM) successfully held Maldives' inaugural Bar Exam (BE2022) on 19 November 2022, with 176 examinees. Administered in two key locations, the capital island Male' City, and the southernmost atoll, Addu City, the BE2022 had a 98.3% turnout for both the morning and afternoon sessions.
The Bar Exam will be administered once every calendar year, and assesses skills at a basic level by addressing a candidate’s analytical abilities and understanding of the law. As such, the Bar Exam sets the minimum benchmark for admission to practice in the Maldives.
Led by key development support from USAID, ABA, Kaplan (UK), and NCBE (USA), the BE2022 is a multiple-choice exam, testing the knowledge to practice in Tort Law, Criminal Law and Procedure, Constitutional and Administrative Law, Contract Law and Practice, Land Law and Practice, and Maldivian Legal System. The syllabus for the BE2022 was developed by the Bar Exam Committee of Experts, and the dual-language exam, conducted in both Dhivehi and English, consisted of a total of 120 multiple-choice questions.
Together with the support of volunteer lawyers, the BCM also prepared Reading Lists for the six examinable areas, to assist with the preparation for the Bar Exam. The BCM also provided sample practice questions, illustrating the kind of questions that appear on the BE2022, and also conducted a total of 18 lectures during 2022, to provide support to examinees sitting the Bar Exam.
The Bar Exam is one of two essential requirements for becoming licensed to practice as a lawyer, as established under the Legal Profession Act 2019, with the other being the completion of a licensing training programme.
The candidates who sat the BE2022 are the first-ever law graduates to sit the Bar Exam in the Maldives.
ދިވެހިރާއްޖޭގެ ފުރަތަމަ ބާ އިމްތިޙާނު ދިވެހިރާއްޖޭގެ ބާ ކައުންސިލުން މިއަދު ބާއްވައިފިއެވެ. ދެ ސެޝަނަކަށް ބަހާލައިގެން މާލެ އަދި އައްޑޫ ސިޓީގައި ކުރިއަށް ގެންދެވުނު ބާ އިމްތިޙާނުގައި 176 ފަރާތަކުން ބައިވެރިވެ، ރަޖިސްޓަރީ ކުރި ކެންޑިޑޭޓުންގެ 98.3 އިން ސައްތަ ވަނީ އިމްތިޙާނަށް ހާޒިރުވެފައެވެ.
މީލާދީ ކޮންމެ އަހަރަކު އެއް ފަހަރު ބޭއްވުމަށް ކަނޑައަޅާފައިވާ ބާ އިމްތިޙާނުގެ މަޤްސަދަކީ ދިވެހިރާއްޖޭގެ ޤާނޫނީ ދާއިރާއަށް ނުކުންނަން ބޭނުންވާ ފަރާތްތަކުގައި ހުންނަންޖެހޭ އަސާސީ މިންގަނޑު ކަނޑައަޅައި، ފެންވަރު ވަޒަންކުރުމެވެ. މި އިމްތިޙާނު މެދުވެރިކޮށް މި ދާއިރާއަށް އަލަށް ނުކުންނަ ފަރާތްތަކަށް ޤާނޫނީ މަފްހޫމުތައް އެނގޭ މިންވަރާއި، ޤާނޫނީ މައްސަލަ ދެނެގަތުމުގެ ޤާބިލިޔަތުކަން ހުރި މިންވަރާއި، ޤާނޫނީ ޚިދުމަތް ދިނުމަށް ތައްޔާރުވެފައިވާ މިންވަރު ދެނެގަނެވޭނެއެވެ. އެހެންކަމުން، ބާ އިމްތިޙާނަކީ ރާއްޖޭގައި ޤާނޫނީ ވަކީލެއްގެ ގޮތުގައި މަސައްކަތްކުރުމަށް ހުއްދަ ދޫކުރުމަށް ބޭނުންކުރާ މިނިމަމް ބެންޗްމާކެވެ.
ޔޫއެސްއެއިޑް، އޭ.ބީ.އޭ، ކެޕްލާން، އަދި އެން.ސީ.ބީ.އީގެ އެހީތެރިކަމާއެކު ބޭއްވުނު މި ބާ އިމްތިޙާނަކީ މަލްޓިޕްލް-ޗޮއިސް ފޯމެޓަށް، 120 ސުވާލު ހިމެނޭ އިމްތިޙާނެކެވެ. އިނގިރޭސި އަދި ދިވެހިބަހުން ފަރުމާކުރެވިފައިވާ މި އިމްތިޙާނުގެ ސިލަބަސް އެކުލަވާލާފައިވަނީ ބާ އިމްތިޙާނުގެ ކޮމިޓީ އޮފް އެކްސްޕަރޓުންނެވެ. 2022 ވަނަ އަހަރުގެ ބާ އިމްތިޙާނުގައި ހިމެނިފައިވާ މާއްދާތަކަކީ ކޮންސްޓިޓިއުޝަނަލް އެންޑް އެޑްމިނިސްޓްރޭޓިވް ލޯ، ޓޯރޓް ލޯ، ލޭންޑް ލޯ އެންޑް ޕްރެކްޓިސް، ކޮންޓްރެކްޓް ލޯ އެންޑް ޕްރެކްޓިސް، ކްރިމިނަލް ލޯ އެންޑް ޕްރޮސީޖަރ، އަދި މޯލްޑިވްސް ލީގަލް ސިސްޓަމްއެވެ.
ބާ އިމްތިޙާނުގައި ބައިވެރިވުމަށް ބޭނުންވާ ފަރާތްތައް އިމްތިޙާނަށް ތައްޔާރު ކުރުމަށްޓަކައި ބާ ކައުންސިލުން އެކި މަސައްކަތްތައް ކުރިއަށް ގެންގޮސްފައިވެއެވެ. އެގޮތުން، ވޮލަންޓިއަރ އުޞޫލުން ބާ ކައުންސިލަށް ޚިދުމަތްކޮށްދެއްވި ޤާނޫނީ ވަކީލުންގެ އެހީތެރިކަމާއިއެކު، އިމްތިޙާނުގެ ސިލަބަހުގައި ހިމެނޭ ދާއިރާތަކާ ގުޅޭ ރީޑިންގ ލިސްޓު އެކުލަވާލުމާއި، ނަމޫނާ ޕްރެކްޓިސް ސުވާލު ޝާއިޢު ކުރުމުގެ އިތުރުން، މި އިމްތިޙާނަށް ކެންޑިޑޭޓުން ތައްޔާރު ކުރުމަށްޓަކައި 2022 ވަނަ އަހަރު ޖުމްލަ 18 ލެކްޗަރެއް ވަނީ ކުރިއަށް ގެންދެވިފައެވެ.
ބާ އިމްތިޙާނުން ފާސްވުމަކީ ޤާނޫނީ ފަންނުގެ ޤާނޫނުގެ ދަށުން ރާއްޖޭގައި ޤާނޫނީ ވަކީލެއްގެ ގޮތުގައި މަސައްކަތްކުރުމަށް ހުއްދަ ދޫކުރުވޭ ދެ ޝަރުތުގެ ތެރެއިން އެއް ޝަރުތެވެ. ޤާނޫނީ ފަންނުގެ ދަށުން ލާޒިމުކުރާ ދެވަނަ ޝަރުތަކީ ލައިސަންސިންގ ތަމްރީނު ޕްރޮގްރާމެއް ފުރިހަމަ ކުރުމެވެ.
